Nel
film vengono toccati principalmente due temi, entrambi di grande rilevanza nella società statunitense: il rapporto
tra bianchi e neri e la vendetta, collegata alla pena di morte.

Riguardo alla pena di morte, Il momento di
uccidere non è esattamente il solito film di condanna in cui si esplicita il diritto alla vita anche degli assassini:
la provocazione, qui, è 

esattamente opposta. Il film, infatti, presenta la storia di un uomo di colore,
Carl Lee, che uccide gli aguzzini della figlia: al processo dirà che "meritavano di morire", mentre la pena 

che avrebbe inflitto loro lo Stato (10 anni di reclusione) non sarebbe stata sufficiente. La mentalità di Carl Lee
è perfettamente rappresentata dal suo avvocato, il bianco Jake; 

quest'ultimo, infatti, si dichiara in un
frangente non solo favorevole alla pena capitale, ma ritiene che il problema sia proprio come non venga applicata
abbastanza. Jake è quindi 

chiaramente dalla parte del suo assistito: dove la giustizia dello Stato non
può arrivare, il singolo individuo può colmare il divario.

Particolarmente interessante e a dire il
vero un po' confusa è la posizione assunta sul tema da Roark, giovane studentessa di legge che assiste
volontariamente Jake durante il processo. 

Roark, infatti, prima si dichiara progressista e contro la pena di
morte, ma poi si pone chiaramente in difesa dell'azione compiuta da Carl Lee. Da un lato quindi nega allo Stato il
diritto 

di stabilire che alcune persone meritino la morte, siano anche pluriomicidi, ma dall'altro
garantisce invece questo diritto al privato cittadino, che con il suo arbitrio viene 

implicitamente
investito del compito dell'amministrazione della giustizia, diventando giudice e carnefice.

found at a roadside bar, where they had been bragging about what they did to Tonya. Tonya's understandably distraught
and enraged 

father, Carl Lee Hailey, remembers a case from a year ago, when four white men raped an
African-American girl in a nearby town, and got acquitted. Carl is determined to not let that happen 

in this
case. While deputy Dwayne Powell Looney is escorting Pete and Billy Ray up a flight of stairs to a court room, Carl
emerges from the building's basement with an assault rifle, and 

he kills Pete and Billy Ray for what they
did to Tonya...............
